Patient information on data processing as part of the telemedicine consultation service.

Thank you for your interest in our dermatological consultation. The protection of your personal data is very important to us. Below you will find information about the handling of your data collected through your use of our consulting service. Your data will be processed in accordance with the legal regulations on data protection.

Controller and Data Protection Consultant

The controller within the meaning of the FADP (Federal Act on Data Protection) is the dermatologist you have selected. The individual contact details as well as information on any data protection consultant can be found in the description of the dermatologists available on the one hand and the confirmation email after completion of the booking process on the other.

Definitions

Our privacy policy is intended to be simple and understandable for everyone. In this privacy policy, the official terms of the FADP or the General Data Protection Regulation (GDPR) are usually used. The official definitions are explained in Art. 5 FADP/ Art. 4 GDPR.

Processing of personal data in the context of teledermatology consulting services

If you choose www.onlinedoctor.ch use of teledermatological consultation services via the website, the following personal data will be transmitted to us for specialist advice in order to answer the request:

First name and surname, gender, date of birth, address, telephone/mobile number, e-mail, image data based on the photographs of skin changes uploaded by the user, further information may be provided by the user. health data communicated, billing data such as e.g. Name, address, credit card information and/or bank details, health insurance details if applicable.

The data is transmitted by OnlineDoctor to us as dermatologists. The submission starts at the time you start the request in the chatbot. OnlineDoctor arranges the consulting service and operates the platform www.onlinedoctor.ch. For this purpose, we have concluded an agreement with OnlineDoctor AG for order processing. You can find more information on the handling of personal data on the platform under https://www.onlinedoctor.ch/datenschutzerklaerung/.

The data is processed for the purpose of executing the treatment contract between you and the dermatologist you have chosen.

In addition, we would like to point out that OnlineDoctor anonymizes part of the data for statistical purposes.

Preparation of the recommendation for action

After checking your information and providing the specialist medical consultation, you will receive an assessment of your case from us as well as a recommendation for action.

You will receive a link to retrieve it, which will be provided to you by OnlineDoctor by e-mail. The assessment and recommendation for action can only be accessed by means of a patient login (e-mail + password), which you have created as part of the creation of the case. Alternatively, you can also log in to your patient account – via the patient login area – and view the assessment and recommendation for action there.

Data transfer and recipients

Your personal data will not be transferred to third parties unless: – if we have explicitly pointed this out in the description of the respective data processing.- if you have given your express consent to this, – the disclosure is necessary for the assertion, exercise or defence of legal claims and there is no reason to assume that you have an overriding interest worthy of protection in the non-disclosure of your data, –  in the event that there is a legal obligation for the disclosure and – insofar as this is necessary for the execution of contractual relationships with you.

In addition, we may use external service providers for the processing of our services, which we have carefully selected and commissioned in writing. They are bound by our instructions and are regularly checked by us. We have entered into order processing agreements with these service providers where necessary. These are service providers for web hosting as well as maintenance and care of our IT systems, etc. The service providers will not pass on this data to third parties.

Data integrity

We meet according to Artt. 7.8 FADP, taking into account the state of the art, the implementation costs and the type, scope, circumstances and purposes of the processing, as well as the different probability of occurrence and severity of the risk to the rights and freedoms of natural persons, appropriate technical and organisational measures are taken to ensure a level of protection appropriate to the risk. This website uses SSL encryption for security reasons and to protect the transmission of confidential content.

Duration of storage of personal data

The duration of the storage of personal data is measured by the relevant statutory retention periods (e.g. from social law, commercial law and tax law). After the respective period has expired, the corresponding data is routinely deleted. If data is necessary for the fulfilment or initiation of a contract or if there is a legitimate interest on our part in further storage, the data will be deleted if it is no longer required for these purposes or if you make use of your right of revocation or objection.

Your rights

Below you will find information on the rights of data subjects that the applicable data protection law grants you vis-à-vis the controller with regard to the processing of your personal data:

The right to request access to your personal data processed by us or to the information listed in Art. 25 FADP.

The right to request the rectification of inaccurate or complete of your personal data held by us without undue delay.

The right to request the erasure of your personal data held by us, unless the processing is necessary for the exercise of the right to freedom of expression and information, for compliance with a legal obligation, for reasons of public interest or for the establishment, exercise or defence of legal claims.

The right to request the restriction of the processing of your personal data if the accuracy of the data is contested by you, the processing is unlawful, but you object to its deletion and we no longer need the data, but you need it to assert, exercise or defend legal claims, or you have objected to the processing

The right to receive your personal data that you have provided to us in a structured, commonly used and machine-readable format or to request that it be transferred to another controller.

The right to complain to a supervisory authority if you believe that the processing of data concerning you violates data protection regulations.

The right to revoke consent: You have the right to revoke your consent to the processing of data at any time with effect for the future. In the event of revocation, we will delete the data concerned without undue delay, unless further processing can be based on a legal basis for processing without consent. The revocation of consent does not affect the lawfulness of the processing carried out on the basis of the consent before the revocation.

Right to object

According to Art. 30 para. 2 b) FADP, you have a right to object to the processing of your personal data.

If you would like to make use of your right of revocation or objection, an e-mail to the e-mail address of the dermatologist you have selected in the confirmation e-mail is sufficient.

Automated decision-making

There is no automated decision-making or profiling.

Reservation of change

We reserve the right to adapt or update this privacy policy if necessary in compliance with the applicable data protection regulations. This allows us to adapt them to current legal requirements and take into account changes to our services, e.g. when introducing new services. The most recent version applies to your visit.
